Terms and conditions

1. Who sells

The products in this shop are sold by:

In these terms, “we” means the seller above and “you” the person buying. The shop runs on the Vindesto platform, operated by [company name], which hosts it and manages your account. Vindesto is not the seller: you make the contract of sale with us alone.

2. Your account

  • To order you need a Vindesto account. You sign in with your e-mail address and a code we e-mail you, without a password.
  • The same account also works in other shops on Vindesto. Its rules are in the Vindesto terms.
  • Make sure your details are correct and that only you can get into your mailbox: anyone who can read it can sign in to your account.
  • We may block a customer in our shop only for a serious reason, for example fake orders or parcels refused again and again without reason. We tell you why. Even when blocked, you can return products you have already bought.

3. Products and prices

  • Each product's main characteristics are written on its page. Photos show the product as faithfully as we can; colours may look slightly different depending on your screen.
  • Prices are in RON and include VAT at 21%. Delivery is not included (section 7).
  • When we show a reduction, the price before it is the lowest price we asked in the 30 days before the reduction (Romanian GD 947/2000, Article 4^1).
  • The stock shown updates with every order. If we still cannot deliver a product, we tell you before confirming the order and you pay nothing for it.

4. How to order

  1. Add products to the cart and press “Checkout”.
  2. Sign in with your e-mail address and the code sent to it.
  3. Choose or enter the delivery address and the contact person.
  4. Choose who the invoice is for: you, at the same address or another, or a company.
  5. Check everything: the products, the prices, the addresses and payment on delivery. You can add notes.
  6. Press “Order with obligation to pay”.
  • Until the last step you can correct anything: in the cart you change products and quantities, and at the review every section has a “Change” button.
  • You can order in Romanian or English.
  • Once you place the order, you find it at any time in your account, under “My orders”. By e-mail you get the confirmation that we received it, with the information on returns, the return form and the notice on the legal guarantee.
  • These terms stay published here and you can print or save them at any time. Your order follows the version in force on the day you placed it.

5. When the contract is made

Your order is an offer to buy. The e-mail you get right after ordering only confirms that we received it, not that we accepted it.

We contact you, usually on the phone number given for delivery, to confirm the products and tell you the delivery cost. The contract of sale is made when we confirm your order by e-mail, after you have accepted that cost (Romanian GEO 34/2014, Article 8(9)).

Until we confirm it, you can cancel the order free of charge: write to us or call us. We may also refuse an order, for a serious reason (for example, the product is no longer available or the price shown was obviously wrong); then we tell you why.

6. Payment

You pay on delivery: to the courier, when the parcel arrives, in cash or by card if the courier company takes cards. You pay the price of the products plus the delivery cost you accepted at confirmation. If there is a fee for paying on delivery, it is part of that cost and is no higher than what we pay for it (Romanian GEO 34/2014, Article 19^1). We issue the invoice as the law requires and send it in the parcel or by e-mail.

7. Delivery

  • We deliver only in Romania, by courier, to the address chosen with the order. We tell you the cost and the estimated time before confirming the order. There are more details on the Delivery page, if we have published it.
  • We deliver within the time given at confirmation, and no later than 30 days after the contract is made. If we cannot, you can cancel the order, and if you paid anything, we pay it back at once.
  • From the moment you, or someone you choose (not the courier), receive the parcel, you bear the risk if the products are lost or damaged.
  • Check the parcel on delivery, in front of the courier, and tell us if it is damaged.
  • Refusing the parcel at delivery does not mean you have made a return. To return, send the return request within the period in section 8; you can send it before the parcel arrives, too.

8. Returning products (the right to withdraw from the contract)

If you bought for yourself, not for your business or profession, you can return the products within 14 calendar days of receiving them, without saying why. The law calls this “the right to withdraw from the contract” (Romanian GEO 34/2014, Article 9).

  • Ask for the return from the order's page, with the “Return the products” button, or write to us.
  • Send us the products within the next 14 days. You pay for sending them back.
  • We give you your money back within 14 days of your request, by bank transfer, without any fee. We may wait until we have the products or proof that you sent them.
  • You may open the parcel and try the products, as you would in a shop. If you use them more than that, we may take off the money the value they lost.

The steps, the deadlines, the products that cannot be returned, the text the law requires and the return form are in the return policy, which is part of these terms.

9. Legal guarantee (faulty products)

We are responsible if a product is faulty, does not work as it should or does not match its description. The law calls this a “lack of conformity”. We are responsible for any such problem the product had at delivery that comes to light within 2 years of delivery (Romanian GEO 140/2021). If it comes to light in the first year, the law assumes it existed at delivery, so you do not have to prove it.

  • You can ask us to repair or replace the product, free of charge. We do it within 15 calendar days of you telling us. If the problem appears in the first 30 days after delivery, you can ask straight away for a replacement.
  • If repair or replacement is impossible, we do not do it in time or the problem comes back, you can ask for a price reduction or your money back.
  • There is no deadline for telling us. Tell us as soon as you can, so we can fix it quickly. We need proof of purchase, such as the invoice or the order confirmation e-mail.
  • A commercial guarantee, if the producer or we offer one, adds to the legal guarantee and does not replace it.

Below is the European Union's official notice on the legal guarantee:

Legal guarantee of conformity

Every product bought here comes with a legal guarantee of conformity of at least two years. Below is the European Union's official notice.

The European Union's harmonised notice on the legal guarantee of conformity, a minimum of two years for goods bought in the Union

10. Complaints and disagreements

For any problem, write to us at hello@marketimpex.ro, call us on [phone] or use the contact page. We answer as quickly as we can, within 30 days at most.

If we cannot agree, you can turn to:

  • Romania's National Authority for Consumer Protection (ANPC), at www.anpc.ro;
  • ANPC's alternative dispute resolution service (SAL), at reclamatiisal.anpc.ro: it is free, you take part only if you want to, and it does not stop you going to court;
  • the European Consumer Centre Romania, if you live in another country of the European Union, at eccromania.ro;
  • the courts, including those where you live.

11. Liability

These terms take away none of the rights the law gives you. We are not liable for delays or undelivered orders caused by an event we could not foresee or prevent, such as a flood (force majeure), provided we tell you at once. Nor are we liable for problems caused by using a product other than as its instructions say.

12. Personal data

What data we use for your order and why is explained in the privacy policy, and what we keep in your browser in the cookie policy.

13. Governing law

The contract follows Romanian law. If you live in another country and we sell there too, you also keep the protection of your country's mandatory rules. No clause obliges you to go to a particular court or to arbitration.

14. Language and changes

The terms are written in Romanian and English, with the same content. We may change them for future orders. The date of the last update is shown at the top, and an order placed follows the terms in force on the day it was placed.
